Products Liability

Louisville, Kentucky, Product Liability Attorneys

Consumers expect that the products they purchase will be safe to use — it is an implied warranty that covers almost everything we buy. So, when a defective product causes injury or death, the entities responsible for the defect can be held liable for the injuries sustained. This is called a product liability lawsuit, and if you have been injured by a defective product, you should hire a lawyer to file one.

How Product Liability Lawsuits Work

In a typical product liability lawsuit, it must be shown that the plaintiff was injured because the product did something that he or she could not have reasonably anticipated. This can involve a few factors:

  • Manufacturing defects: the product malfunctioned because of an error in production
  • Design defects: the product was inherently dangerous because of poor or negligent design
  • Failure to warn: the product becomes dangerous in certain circumstances, but since there was no warning, the injured party had no reason to suspect danger

Any kind of product can lead to a product liability lawsuit when it causes an injury. But injuries are most often caused by products like home appliances, automobiles, dangerous toys, medical devices and defective drugs. Even office equipment can sometimes cause injury, and at Sitlinger, McGlincy, Theiler & Karem, we have in fact represented a client who was injured by a defective paper shredder.

In addition, we sometimes represent defendants in personal injury lawsuits. This practice on our part gives us firsthand insight into the legal and practical hurdles a plaintiff may face in pursuing a products liability claim.
